General Terms

TERMS AND CONDITIONS OF USE

Hwinyo provides and operates a Voice over IP (VoIP) telecommunications service and distributes a VoIP application for mobile devices (Android and iOS), referred to as the "Application." This service is available to individuals for both personal and business purposes.

The Service and Application, as well as additional support, maintenance, and development services, are described on the Hwinyo website. These General Terms and Conditions govern the use of the Service and the Application by the User.

1. DEFINITIONS

For the purposes of these Terms and Conditions, the following terms are defined as follows:

  • Application: The Hwinyo app for Android, available for download on the User's device, published by Hwinyo.
  • Personal Data: Any personal information of the User processed by the Application when used.
  • Data: Any data and content provided by the User on the Application and processed by it.
  • Service: The Hwinyo VoIP service allowing users to make audio calls using the SIP protocol. The Service is available for free, either online or via the Application, as specified in these Terms and Conditions.
  • Site: The Hwinyo website, operated by Hwinyo, detailing the functionalities and requirements of the Service, and offering access to download the Application.
  • Device: A telecommunications device, such as a smartphone, tablet, or PC, that allows the Application to be downloaded and the Service to be used.
  • User: A natural person who has downloaded and is using the Application or Service for personal or professional purposes.
  • Contact Person: A natural person, User of the Service, with whom the User interacts via the Application.

2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS

These Terms and Conditions (hereinafter referred to as the "T&Cs") define the conditions under which the User may access the Application and use the Service. The T&Cs are accessible at any time via the Application and the Site.

By downloading the Application and subscribing to the Service, the User agrees to the full and unreserved acceptance of these T&Cs. Hwinyo reserves the right to modify or supplement these T&Cs at any time, with such changes subject to new acceptance by the User.

3. SERVICE DESCRIPTION

The "Hwinyo SIP Service" offers the following key features:

  • Audio over IP calls
  • Audio conferencing

This list may be updated at any time by Hwinyo CONNECT, with the User acknowledging that no compensation is due to the User for these modifications, given the free nature of the Service and Application.

4. ACCESS TO THE SERVICE

4.1. User Account

To access the Service, the User must have a compatible Device that meets the technical requirements listed on the Site. The User can access the Site to download the Application or use a store (Google Play Store, Apple Store).

The User will then create a personal account by providing the necessary information (e.g., telephone number). The User must choose a personal password, which is confidential and non-transferable. The User is responsible for maintaining the confidentiality of the password and account information.

Hwinyo is not liable for any damage resulting from unauthorized access to the User’s account due to the disclosure of their credentials or security breaches on the User’s Device.

The User may close their Account at any time via the Application, without requiring Hwinyo’s assistance.

4.2. Free Service

The Service is free for all users, provided that the T&Cs are adhered to. The User may subscribe to additional support, maintenance, or specific development services by contacting Hwinyo.

5. PERSONAL USE OF THE SERVICE

The Service may be used for personal or professional purposes. However, a User Account must remain strictly personal and for the sole use of the individual User. The Service may not be shared collectively (e.g., with other employees of the same company).

Each employee wishing to use the Service must create a separate User Account. The automated or bulk creation of User Accounts is strictly prohibited. Hwinyo reserves the right to suspend or terminate any account created in violation of this rule.

6. INTELLECTUAL PROPERTY

6.1. License to use the Application

The Application is released under the free GNU GPL v.3 license. The User is granted certain rights under this License. For more information on these rights and obligations, the User should refer to the terms of the License or consult Hwinyo.

If preferred, the User may opt for a proprietary license for the Application source code and additional services (support, consulting, development) for a fee, based on a prior quote from Hwinyo.

6.2. Intellectual Property

The Application, Service, and all components thereof (including source code, graphic design, and database) are protected by intellectual property laws. Reproducing or modifying the Application's logo or the "Hwinyo" name is strictly prohibited without written consent from the copyright holders.

6. USER COMMITMENTS

The User is responsible for using the Application in accordance with all applicable laws and regulations. This includes respecting the rights of Contacts and avoiding illicit data collection or inappropriate content dissemination.

7. DATA SECURITY

7.1. User Account Security

The User is responsible for maintaining the security of their User Account and any data stored therein. To ensure this, it is recommended that the User:

  • Choose a strong password (minimum 8 characters, including upper and lowercase letters, numbers, and special characters).
  • Install antivirus software on their Device.
  • Lock their Device with a password or use biometric identification (e.g., fingerprint, facial recognition).

Additionally, the User is encouraged to back up their data on an external medium or service for extra protection.
